The Pope initiates a dialogue with the Enlightenment tradition and develops the theological and philosophical foundations of the culture of human rights. Karola Wojtyła’s personalistic thought appears to be a very coherent and reliable key to understand the doctrine of human rights. Wojtyła stresses subjectivity and non-reducibility of the person as a concrete human „I.” It is both autonomy and transcendence that constitute dignity of the person towards (...) other personal and impersonal beings. Już sam tytuł recenzowanego tomu ewokuje przemyślenia dotyczące wielkich sporów moralnych z przeszłości i skłania do postawienia pytania o ich aktualność. W konsekwencji tego pojawia się kolejne pytanie: czy prowadzony przez autorów i redaktorów tomu dyskurs zamyka się w obszarze historii (w szczególności historii filozofii), ewentualnie teoretycznych dywagacji intelektualnych, czy też posiada wymiar praktyczny? W mojej ocenie praca posiada walory teoretyczny i praktyczny. Przygotował ją interdyscyplinarny zespół dwudziestu autorek i autorów (z uzasadnioną dominacją liczebną filozofek i filozofów), którzy (...) przygotowali dwadzieścia esejów, mierząc się z szerokim spektrum tematów. W założeniu mamy więc do czynienia z niezwykle ambitnym projektem. Wnikliwa lektura tomu potwierdza, że cele, które postawili przed sobą jego redaktorzy i autorzy, zostały z powodzeniem zrealizowane. Oddany właśnie do rąk czytelników tom pt. _Spory moralne_ powinien znaleźć się w bibliotekach szkolnych (mam na myśli szkoły średnie) i akademickich. Może również stanowić źródło wiedzy i inspiracji dla ludzi pióra, dla duchowieństwa, dziennikarzy, prawników i polityków. (shrink)

Słownik języka polskiego PWN odnotowuje m.in. trzy znaczenia słowa „fenomen”: (1) rzadkie, niezwykłe zjawisko; (2) osoba wyjątkowa, niezwykle uzdolniona; (3) fakt empiryczny będący punktem wyjścia badań naukowych. W tytule nie chodzi o „fenomen” w sensie drugim, chociaż do Szkoły Lwowsko-Warszawskiej należało wiele osób wyjątkowych i niezwykle uzdolnionych, do których z powodzeniem można odnosić słowo „fenomen” w tym sensie. Tytułowy zwrot „Fenomen Szkoły Lwowsko-Warszawskiej” sygnalizuje natomiast, z jednej strony, że książka zdaje sprawę z badań naukowych nad pewnym złożonym „faktem empirycznym” – (...) nad pewną formacją intelektualną wraz z jej dorobkiem. Z drugiej strony tytuł wskazuje na rzadkość i niezwykłość Szkoły: to, że była ona fenomenem nie tylko w dziejach Polski, lecz także w dziejach kultury in toto. Oto kilka faktów, które się na fenomen Szkoły – w tym drugim sensie – składają. Za początek Szkoły przyjmuje się rok 1895, kiedy jej założyciel, Kazimierz Twardowski, przybył z Wiednia do Lwowa i już wkrótce wypromował pierwszych doktorów. Wśród wychowanków (doktorantów) Twardowskiego było ponad dwudziestu przyszłych profesorów tytularnych, którzy w dwudziestoleciu międzywojennym zajęli większość katedr filozofii, logiki i psychologii, ale oddziałali także na inne dyscypliny – takie jak literaturoznawstwo, muzykologia, filologia klasyczna etc. Twardowski zmarł w 1938 roku, a za koniec Szkoły niektórzy przyjmują rok 1939 – istotnie II wojna światowa spowodowała spustoszenie w szeregach przedstawicieli Szkoły, a jeszcze silniejszy cios stanowił dla niej okres stalinizmu. Jednakże Kilka wybitnych postaci Szkoły – takich jak Kazimierz Ajdukiewicz, Tadeusz Czeżowski, Izydora Dąmbska, Tadeusz Kotarbiński, Stefan Swieżawski czy Władysław Tatarkiewicz – działało jeszcze wiele lat po wojnie, wychowując kolejne pokolenia w duchu właściwego Szkole antyirracjonalizmu. Wielu spośród autorów tekstów do niniejszego tomu to przedstawiciele młodszych pokoleń Szkoły Lwowsko-Warszawskiej sensu largo. Spoiwem Szkoły był nie pewien zespół idei, który wyznawaliby jej członkowie, lecz pewne postulaty metodologiczne oraz pewien zestaw wartości, które były w Szkole akceptowane przez kolejne pokolenia. O tych postulatach metodologicznych i o tym zestawie wartości mówią szczegółowo autorzy tekstów tu zamieszczonych. Ogromnemu wpływowi Szkoły na kulturę polską towarzyszyła recepcja wyników osiąganych przez jej członków za granicą. Naszym „towarem eksportowym” była szeroko rozumiana logika (logiki wielowartościowe i metalogika Łukasiewicza, gramatyka kategorialna Ajdukiewicza, koncepcja prawdy Tarskiego). Wiele osiągnięć członków Szkoły w innych dziedzinach zagranica odkrywa dla siebie dopiero dziś i wyniki te budzą podziw u tych, którzy się z nimi stykają. Ideą stojącą za powstaniem „Fenomenu Szkoły Lwowsko-Warszawskiej” była chęć ukazania Szkoły w jak najszerszej perspektywie, także przez pryzmat mniej znanych, choć ważnych postaci i osiągnięć. Cílem článku je ukázat přínos tradičního pragmatismu, a to s ohledem na nutnost vypracování hodnotově podmíněného bádání, jehož východiskem je praxe. V rámci jednání se ukazuje klíčová role zkušenosti, což je aspekt, který je stěžejní pro klasický empirismus, ovšem v kontextu pragmatismu je určujícím způsobem revidován. Z pragmatistického úhlu pohledu je zkušenost, stojící v základu poznání, nahlížena jakožto aktivní proces, během nějž člověk kooperuje s prostředím, které ho obklopuje, čímž neustále získává podněty pro konstituování vlastních přesvědčení, která se navzájem doplňují (...) a podmiňují. Povaha našich přesvědčení, vzešlých z interakce s okolním prostředím, se potom vysvětluje s odkazem k tomu, co činíme a jak následně toto konání interpretujeme. Text se nejprve zaměřuje na hodnotově neutrální koncepci vědeckého bádání, již předložil M. Weber. V opozici k weberovskému projektu jsou poté rozvíjena stanoviska (neo)pragmatismu, jež oscilují kolem holistického aspektu filosofie pragmatismu, jenž vyzdvihuje vzájemné propojení vědeckých teorií a filosofických přesvědčení, usiluje tak o zrušení distinkce panující mezi faktem, teorií a hodnotou či mezi myšlením a zkušeností a ukazuje tak, jakým způsobem lze za přispění pragmatismu překlenout tradiční dichotomie, jež jsou jednak neodlučitelně spjaté s předchozí filosofickou tradicí a které jsou rovněž nadále přítomny v sociologickém paradigmatu M. Cílem článku je podat kritický rozbor predikcí týkajících se budoucnosti sociálních věd, jak je formuluje Ladislav Kvasz pod záštitou svého projektu „formální epistemologie". Modelem dynamiky vztahů mezi obory na vědeckém poli nabízí Kvasz v otázce střídání paradigmat alternativu ke Kuhnově teorii vědeckých revolucí. Text zkoumá, na jakých základech je mechanismus změn u Kvasze vystavěn a co z toho plyne pro relevanci předpovědí z tohoto modelu vyvozených - především těch o sociálních vědách. K tomu slouží souběžné představení historické metody Michela (...) Foucaulta, který zdůrazňuje potřebu vyvarovat se zavádění falešných kontinuit ve zkoumání trajektorií vědeckých oborů, u kterých dochází ke zlomům v jejich epistemické struktuře. Zvláštní zřetel je kladen na souvislost predikcí s možnostmi odlišit epistemologicky a sociologicky uchopitelné prvky spojené s chodem vědy. Jako klíčový moment se tedy ukáže možnost práce se sociálně vědními obory pomocí jemných nástrojů, které Kvasz vyvinul na vědách exaktních. (shrink)

Článek analyzuje funkci, kterou v díle raného M. Heideggera plní myšlenka destrukce, a zkoumá na tomto základě, jak je obecně možné charakterizovat vztah mezi hermeneutikou a destrukcí, resp. vzhledem k pozdějšímu vývoji filozofie mezi hermeneutikou a dekonstrukcí. Při analýze pojmu destrukce je položen důraz na to, jak je postup destrukce použit na tradici aristotelské substancialistické ontologie a na Kantovu teorii poznání, což jsou dvě klíčová témata raného Heideggera. Při zkoumání vztahu mezi hermeneutickou a dekonstruktivní intencí filozofování se naproti tomu (...) článek soustředí na to, jak jsou oba tyto přístupy rozvinuty u pozdějších autorů, na něž měla Heideggerova filozofie silný vliv: u J. Derridy a u H.-G. Gadamera. V závěru článku je upozorněno na to, že určité pojítko mezi hermeneutikou a dekonstrukcí lze navzdory všem rozdílům spatřovat v pojmu kritiky. (shrink)

The early decades of the last century saw European philosophical thought becoming increasingly interested in the sociological extension of the idea of law. From the viewpoint of the sociology of law, law is formed in the process of social interactions and is not sanctioned by the state. Sergey Hessen and Georges Gurvitch base their conceptions of social law on the sociology of law in the 1920s and 1930s. They start a polemic in the pages of the journal Sovremenniye zapiski. Although (...) they differ radically in their definitions of the status of the state they concur in defining society as a set of social institutions and communities existing as instruments for expressing personal freedom. The social regulations they propose are already legal situations. Hessen and Gurvitch believe that the individual can fully exercise his/her freedom only in conditions of such legal pluralism. However, the concept of legal pluralism involves an inherent problem of preserving social unity: why is it that society does not fall into a range of autonomous social entities, each offering the individual its own legal order for actualising freedom? To solve this problem the philosophers use the concept of “the general will”. General will is an instrument of correlation between individual freedom and the development of society and culture as a whole. The object of philosophical dispute is how the general will is formed: 1) in the process of social self-organisation according to Gurvitch; 2) in the operation of the suprafunctional organisation according to Hessen. The difference in the grounding of the general will leads to a difference in the concepts of social unity: 1) sobornost according to Gurvitch and 2) solidarity according to Hessen. Analysis of the dispute between Gurvitch and Hessen brings out not only the differences in the interpretation of social unity but also the fundamental problems with the conceptions of social law. Neo-republicanism seems well suited to provide insight into current policies for the control and restriction of immigration. In this paper, I discuss three different accounts of domination to assess whether they can provide intuitively acceptable responses to the types of domination experienced by different groups of immigrants. First, I present and criticize an argument offered by Philip Pettit in support of the view that immigration restrictions could in principle avoid being dominating. My criticism focuses on Pettit’s account of non-arbitrary governmental (...) action that claims that laws and policies are not dominating when people have democratic control over the government’s activity. Given the failure of Pettit’s argument, I turn to the proceduralist account of non-arbitrary state action proposed by Frank Lovett, and discuss the limitations of the account in diagnosing all ways in which border controls and immigration policy can generate domination. Finally, I present and defend the view that governmental action is not dominating when there are adequate checks that protect the objective interests of individuals. (shrink)

We motivate and introduce a new method of abduction, Matrix Abduction, and apply it to modelling the use of non-deductive inferences in the Talmud such as Analogy and the rule of Argumentum A Fortiori. Given a matrix $${\mathbb {A}}$$ with entries in {0, 1}, we allow for one or more blank squares in the matrix, say a i,j =?. The method allows us to decide whether to declare a i,j = 0 or a i,j = 1 or a i,j =? (...) undecided. This algorithmic method is then applied to modelling several legal and practical reasoning situations including the Talmudic rule of Kal-Vachomer. We add an Appendix showing that this new rule of Matrix Abduction, arising from the Talmud, can also be applied to the analysis of paradoxes in voting and judgement aggregation. In fact we have here a general method for executing non-deductive inferences. (shrink)

This paper argues that consciousness can, and often does, extend beyond the confines of the skull and skin. Conscious acts can extend to the extent they are intentional. Intentionality is revealing activity, and revealing activity often straddles processes occurring both inside and outside the subject’s body. What makes a conscious act extended is identical with what makes it intentional.

Scholars offer several options for Matthew’s value of the leper’s story in his narrative that range from revealing Jesus’ attributes of compassion and sympathy, manifesting God’s empire, to portraying Jesus’ function as a temple. Although these suggestions aptly portray Matthew’s rhetorical use of the leper’s healing in his narrative to address societal concerns of his time, for lack of referring to the social setting of the narrative, they do not capture the holistic healthcare system embodied by Jesus in Matthew’s narrative (...) that portrays Jesus as a superior healer to the rest of the other healers in the Roman Empire. The findings of the research for this article establish the argument that employing ethnomedical anthropology as a lens to read the leper’s healing narrative in Matthew 8:1–4 in the context of Matthew’s social setting reveals Matthew’s ideology for a transcendent and immanent Christology. The aim of the article is to demonstrate the effectiveness of medical anthropological theory in explaining the dynamics of health and healing reflected in biblical texts.Contributions: This article contributes to the interdisciplinary approach to the study of religion by employing a ethnomedical anthropological perspective to read the leper’s healing in Matthew 8.1–4 in reference to the first century CE health systems in the Roman Empire. This approach procured that Matthew’s immanent and transcendent perspectives of Christology is crucial in demonstrating the text’s function in constructing and sustaining the identity of Matthew’s community in antiquity. Wines with geographical indication can be classified and represented by such features as designations of origin, producers, vintage years, alcoholic strength, and grape varieties; these features allow us to define wines in terms of a set of necessary and/or sufficient conditions. However, wines can also be identified by other characteristics, involving their look, smell, and taste; in this case, it is hard to define wines in terms of necessary and/or sufficient conditions, as wine concepts exhibit typicality effects. This is a (...) setback for the design of computer science ontologies aiming to represent wine concepts, since knowledge representation formalisms commonly adopted in this field do not allow for the representation of concepts in terms of typical traits. To solve this problem, we propose to adopt a hybrid approach in which ontology-oriented formalisms are combined with a geometric representation of knowledge based on conceptual spaces. As in conceptual spaces, concepts are identified in terms of a number of quality dimensions. In order to determine those relevant for wine representation, we use the terminology developed by the Italian Association of Sommeliers to describe wines. This will allow us to understand typicality effects about wines, determine prototypes and better exemplars, and measure the degree of similarity between different wines. (shrink)

Some patients have no chance of surviving if not treated, but very little chance if treated. A number of medical ethicists and physicians have argued that treatment in such cases is medically futile and a matter of physician discretion. This paper critically examines that position.According to Howard Brody and others, a judgment of medical futility is a purely technical matter, which physicians are uniquely qualified to make. Although Brody later retracted these claims, he held to the view that physicians need (...) not consult the patient or his family to determine their values before deciding not to treat. This is because professional integrity dictates that treatment should not be undertaken. The argument for this claim is that medicine is a profession and a social practice, and thus capable of breaches of professional integrity.Underlying professional integrity are two moral principles, one concerning harm, the other fraud. According to Brody both point to the fact that when the odds of survival are very low treatment is a violation of professional integrity.The details of this skeletal argument are exposed and explained, and the full argument is criticised. On a number of counts, it is found wanting. If anything, professional integrity points to the opposite conclusion. (shrink)

Since the arguments that Plato provides in the Republic for the thesis that the human soul consist of three parts (reason, spirit, appetite) are notoriously problematic, I propose other reasons for accepting tripartition: reasons that we too could endorse, or at least entertain with some sympathy. To wit, (a) the appetitive part of Plato's divided soul houses desires and tendencies we have because we are animal bodies programmed to survive (as individuals and as a species) in disequilibrium with a variegated, (...) often varying environment, (b) the spirited middle part houses status concerns that belong to us as social animals, while (c) what makes us rational animals is a faculty of reason, conceived in strikingly non-Humean terms, which determines what is best all things considered. Other psychic tendencies may then be explained in terms of the education and mutual interaction of the three parts we are 'programmed' for from birth. (shrink)
